Terms and conditions of use

The World Database on Protected Areas (WDPA) is compiled from multiple sources and is the most comprehensive global dataset on marine and terrestrial protected areas available. It is a joint venture of UNEP and IUCN, produced by UNEP-WCMC and the IUCN World Commission on Protected Areas (IUCN-WCPA) working with governments and collaborating NGOs.

The World Database on Protected Areas has been made available to web-download in the public domain under the principals of Conservation Commons. The overarching goal of these principles is to make data more freely available to improve conservation.

Access to all WDPA data (or the "WDPA materials") is provided with the knowledge that the end-user read and consents to be bound to the terms outlined in these Terms of Use. The Terms of Use of the WDPA are aimed at two "end-users":

Those individual(s) who, for non-commercial purposes only, want to access the data to search, display and view on-screen for educational-research and those "other" end-users who, for non-commercial purposes only, want to publish the data online through other websites and/or Internet Map Servers or in publications/reports.

All end-users must abide to the conditions identified in the terms for Use of the Database. If you wish to publish the WDPA online, you are asked to abide in addition to the Guidelines listed in Publishing WDPA data in publications or online.

The WDPA data has been produced by combining various sources at a variety of scales at different times for the purpose of improving the quality and quantity of data in the database. While all efforts have been made to ensure the quality and reliability of the data on this media, UNEP, IUCN, and UNEP-WCMC take no responsibility whatsoever for errors or omissions and offers on guaranties or warranties about the suitability of this data for any particular use. WDPA data are considered to be a WORK IN PROGRESS.

UNEP, IUCN and UNEP-WCMC will not be responsible for negligence, strict liability or otherness in the use of WDPA data by other users as a result of posting data in other websites. The user and webmaster at their own discretion and risk will be solely responsible for any damage to their and others user's computer systems as a result of attempts in downloading WDPA data through the public domain.

Except where otherwise stated, UNEP and IUCN are the copyright holders for all Content of WDPA 2007 data. Users may not modify in any way any of the Content protected by these copyrights while, on purpose, intending to alter the integrity of the original. If you wish to publish the content of the WDPA data (the "WDPA Materials"), please be aware that any publication or published analyses using the WDPA Materials must be approved or reviewed by UNEP-WCMC prior to publication, send an email to protectedareas@unep-wcmc.org. You must also abide by the following additional conditions: Conditions of use:

  1. The 'WDPA Materials' can be made available to external users for research, educational purposes and specifically for non-commercial use only and under the Terms of Use.
  2. Always ensure that the latest released version of the WDPA Materials is being used.
  3. The WDPA Materials must not be modified, improved, changed in format or appearance.
  4. The WDPA Materials should be clearly identified with the year of release and type of data acquisition (see suggested citations). It must also include all associated metadata containing the technical description of the information as well as the terms of use, which should be clearly visible and accessible to the user at all times.

If you provide any continuing electronic access to this web-download all necessary steps must be taken to ensure that this web-download is replaced by the latest available version available from the Website, and that no use is made after the currency of the data in this web-download has expired. Governing Law and Jurisdiction.
This Agreement shall be governed by the two major international treaties governing copyrights: the Berne Convention (U.S. Senate Treaty Doc. 99-27, KAV 2245, 1 B.D.I.E.L. 715; also reprinted at 17 U.S.C.A. 104) and the Universal Copyright Convention (U.C.C.), (25 U.S.T. 1341, T.I.A.S. 7868, 1 B.D.I.E.L. 813 (1971 Paris text); and 6 U.S.T. 2731, T.I.A.S. 3324, 216 U.N.T.S. 132 (1952 Geneva text)). (Note: the abbreviation U.C.C. denotes the Universal Copyright Convention). If any term or provision of this Agreement is for any reason held to be invalid, such invalidity shall not affect any other term or provision, and this Agreement shall be interpreted as if such term or provision had never been contained in this Agreement. This Agreement contains the entire understanding between UNEP-WCMC and the user with respect to its subject matter.

Any dispute, controversy or claim arising out of or relating to these terms and Conditions or the agreement consituted under them, or the breach, termination or invalidity thereof, that cannot be resolved by negotiation shall be submitted to conciliation in accordance with the UNCITRAL Conciliation Rules. The place of conciliation shall be London, England. The language to be used in the conciliation shall be English. If, and to the extent that any such dispute, controversy or claim has not been settled pursuant to the conciliation within sixty (60) days of the commencement of the conciliation it shall, upon the filing of a Request for Arbitration by either party, be referred to and finally determined by arbitration in accordance with the UNCITRAL Arbitration Rules as at present in force. There shall be a sole arbitrator. The place of arbitration shall be London, England. The language to be used in the arbitral proceedings shall be English.

So far as may be relevant, the place of performance of the agreement consituted under these Terms and Conditions shall be the place where this Web-download is served, namely England and Wales.

Indemnity.
You agree to indemnify and hold UNEP-WCMC, and their partners, subsidiaries, affiliates, officers, agents and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of content posted, uploaded, downloaded or in any way transmitted by you, including any violation of any copyrights or other legal rights of another

Limitation of liability and exclusion of warranties
Some content in this web-download is provided by voluntary sources. The IUCN does not necessarily verify or authenticate content. Accordingly, you must not take any material action or sanction any in-action in reliance on the content without first checking the accuracy by some other means.

Termination
UNEP-WCMC may terminate any rights granted by UNEP-WCMC in accordance with these Terms and Conditions upon e-mail notification or notification on the Website. Such termination will be deemed effective 60 days posting on the Website or, in the case of notification by email only, 60 days after the receipt of notification by email by you.
